INFORMATION MEMORANDUM REGARDING THE PROCESSING OF PERSONAL DATA
1.Who is the administrator?
1.1.The company JAD Productions, sro, registered office in Prague 2, Záhřebská 23, postal code: 120 00, ID number: 247 44 743, registred in the Commercial Register kept by the Municipal Court in Prague, file number C 170742 (Administrator, or to designate JAD Productions sro as Administrator, we use the term “we”).

JAD Productions s.r.o., through its division known as JAD People, operates, among other things, as a casting and art agency, which, from the conceptual definition of this activity, maintains a database of hitherto publicly unknown persons who show interest in participating in audio, audio-visual and photographic recordings ( especially auditions and castings for acting in advertising, film, etc.). Legal regulations refer to such persons as data subjects – we, as data subjects, will refer to you as “you” in the text below.
1.3. If you are interested in our services in the field of casting, we will, based on the contractual relationship concluded between us, perform activities aimed at learning about the casting / bankruptcy organized by a third party – the organizer, for which you meet the requirements set by the organizer (eg competition for the role of a girl – a blonde, aged 16). In specific cases, we can also provide you with additional administrative support, especially in a situation where you succeed in the bankruptcy and mediate communication between you and the production. If you meet the requirements, we will inform you about the casting / bankruptcy via the contact information you have chosen. If you are interested in participating in the casting / audition, we will send the organizer your photos with your name and year of birth (in some cases, the organizer may omit this first round). If you are interested in the organizer, he will invite you to personally participate in the next round. You fill in the so-called casting list directly at the organizer, in which you state your personal data and the processor of which becomes the organizer directly.
2. Which personal data do we process?
2.1. In order to fulfill our contractual obligations, to which we are committed in relation to you, we need and process in particular the following data:
(i) Title, name and surname,
(ii) Address,
(iii) Date of birth,
(iv) Bank account,
(v) Telephone number,
(vi) Electronic contact,
(vii) Photographs (faces and figures) that you have provided to us.
2.2. In order to send you information about relevant competitions, we also need to know the following information about you – due to the fact that we receive requests from the organizers of competitions in a similar format (slim tall brunette aged 21, etc.):
(viii) sex,
(ix) height,
(x) weight,
(xi) hair color,
(xii) ethnicity.a
2.3. If you succeed in the competition, we need to tell the organizer or subsequently the production for the preparation of the costume your:
(xiii) measures,
(xiv) shoe size,
(xv) and ready-to-wear size,
We verify the up-to-dateness of this data with you in advance.
We do not use your personal data for other purposes.
3. For what purpose do we process personal data?
3.1. We collect and process personal data for the purpose of:
(i) fulfilling the obligations imposed on us by law,
(ii) to negotiate the conclusion of a contractual relationship with you and to fulfill the obligations arising for us from the contractual relationship concluded with you,
(iii) to protect our legitimate interests.
3.2. We always collect and process personal data only to the extent necessary to fulfill the stated purposes.
4. How was personal data obtained?
4.1. Personal data is obtained directly from you, especially from completed forms, mutual communication or concluded contracts. Exceptionally, we may obtain certain data directly from the organizer of the casting / production, provided that this data has been provided to these entities by you.
5. Will we pass on your personal data to someone else?
5.1. We do not pass on your personal data to third parties, with the exception of the information listed in Article 1.3 above, which we pass on to the organizer of the casting / audition or production in the event of your cast. We do not pass on personal data for further processing for us. Some of your personal data may be accessed, in particular, by a responsible employee of the finance department or an accountant – to the extent necessary to send your fee to a bank account. If necessary, we must provide personal data within the legal limits to state administration bodies, such as tax administrators, courts, bodies active in criminal proceedings, etc.
5.2. We will not transfer your personal data to countries outside the European Union or the European Economic Area, or to any international organization.
6. How long will we process personal data?
6.1. Personal data is kept only for the time necessary to achieve the purpose of processing.
6.2. In general, the time required to achieve the purpose of processing personal data is the duration of the contractual relationship between us. After its termination, then only for the time necessary for (ii) the settlement of mutual rights and obligations and (ii) for the fulfillment of legal obligations, always only to the extent necessary. E.g. As a rule, we will keep the data required for tax and invoicing obligations for five years from the year following the occurrence of the retained fact. Personal data that is important for the exercise of our legitimate interests will be kept for a maximum of three years from the end of the contractual relationship between us.

8. Means and method of personal data processing
8.1. When processing personal data, we choose means that are appropriate in terms of the purpose of processing. We do so so that you do not suffer harm to your rights, especially the right to respect for human dignity. We pay attention to protection against unauthorized interference with private and personal life.
8.2. We process personal data mainly in electronic form in a non-automated manner. We archive the signed contract in paper form.
8.3. Personal data is stored on a company server, encrypted computers / notebooks and a telephone. Only our employee / collaborator (trained in the field of personal data processing) has access to your data, and which access to your personal data is needed to fulfill legal or contractual obligations. The authorized person logs in with a unique personal login password.
8.4. We have adopted internal rules for the management of personal data. Our security infrastructure is regularly reviewed by an external supplier.
9. What are your rights and how can you exercise them?
9.1. We do everything to ensure that the processing of your data takes place properly and, above all, securely. You are guaranteed the rights described in this article, which you can exercise with us at any time.

9.3. All communications and statements about your rights are provided by the administrator free of charge. However, if the request is manifestly unfounded or disproportionate, in particular because it is repeated, we are entitled to charge a reasonable fee taking into account the administrative costs associated with providing the requested information. In case of repeated applications for copies of processed personal data, we reserve the right to charge a reasonable fee for administrative costs.
9.4. We will provide you with a statement and, if necessary, information on the measures taken as soon as possible, but no later than within one month. We are entitled to extend the deadline by two months if necessary and in view of the complexity and number of applications. We will inform you about the extension, including the reasons.
The right to information about the processing of your personal data
9.5. You are entitled to request information from us as to whether personal data is being processed or not. If personal data are processed, you have the right to request information in particular on the identity and contact details of the controller, his representatives and, where applicable, the data protection officer, the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients. on the list of your rights, on the possibility to contact the Office for Personal Data Protection, on the source of processed personal data and on automated decision-making and profiling.
9.6. If we would like to process your personal data for a purpose other than that for which they were obtained, we will provide you with information on this other purpose and other relevant information before the said further processing.
9.7. The information provided to you in the exercise of this right is already contained in this memorandum, but this does not prevent you from requesting it again.
Right of access to personal data
9.8. You are entitled to request information from us as to whether or not your personal data is being processed and, if so, you have access to information on the purposes of the processing, the categories of personal data concerned, recipients or categories of recipients, the retention period of personal data, information about your rights request correction or deletion from the controller, restriction of processing, object to such processing), the right to lodge a complaint with the Office for Personal Data Protection, information on the source of personal data, information on whether automated decision-making and profiling takes place and information on the procedure used , as well as the significance and expected consequences of such processing for you, information and guarantees in the event of a transfer of personal data to a third country or international organization. You have the right to provide copies of the processed personal data. However, the right to obtain this copy must not adversely affect the rights and freedoms of others.
Right of correction
9.9. If, for example, there has been a change of residence, telephone number or other fact that can be considered personal data on your part, you have the right to request the correction of the processed personal data from us. In addition, you have the right to supplement incomplete personal data, even by providing an additional statement.
Right of deletion
9.10. In certain specified cases, you have the right to request that we delete your personal data. Such cases include, for example, that the processed data are no longer needed for the above-mentioned purposes. We automatically delete personal data after the expiration date, but you can contact us at any time with your request. Your request is then subject to individual assessment (despite your right to deletion, we may have an obligation or a legitimate interest in keeping your personal data) and you will be informed in detail about its processing.
Right to restrict processing
9.11. We process your personal data only to the extent strictly necessary. However, if you feel that, for example, we are exceeding the above-mentioned purposes for which we process personal data, you can request that your personal data be processed only for the most necessary legal and contractual reasons or that personal data be blocked. Your application is then subject to individual assessment and you will be informed in detail about its processing. In some cases, we will be entitled (and sometimes obliged) to further process your personal data despite your request.
Right to data portability
9.12. If you wish us to provide your personal data to another administrator, resp. other companies, we will pass on your personal data in the appropriate format to the entity designated by you, unless we are prevented from doing so by any legal or other significant obstacles.
The right to object and automated individual decision-making
9.13. If you discover or believe that we are processing personal data in violation of the protection of your privacy and personal life or in violation of the law (provided that the personal data are processed by the controller on the basis of public or legitimate interest, or are processed for the purposes of direct marketing, including profiling, or for statistical purposes or for purposes of scientific or historical significance), you can contact us and ask for an explanation or elimination of the resulting defective condition.
9.14.You can also object directly to automated decision-making and profiling. However, we would like to inform you that we do not automatically evaluate or use your personal data to profile automatic decision-making in the field of marketing activities.
